The Commonwealth Film – Jason Davis Case

“There’s no such thing as self-defense in mental health. You have to protect the patient…”

Jason Davis (28) had been diagnosed with schizophrenia and bipolar disorder and had been in and out of mental hospitals since he was 17. He had been committed to Westborough State Hospital in Massachusetts for threatening his father.

On Aug. 12, 1993, Jason and fellow patient Dean slipped out of the hospital and bought some alcohol at a liquor store down the road. They were celebrating Jason’s birthday. Officer Gregg Plesh found them and brought them back without incident. Once back at the hospital, Jason resisted and was brutally attacked by hospital staff and caretakers. One of the caretakers attempted to kill him.

Jason sued the state of Massachusetts and won.
The state appealed, and Jason won.
The case went to the Supreme Court, and Jason won.

Massachusetts was ordered to pay millions. But to this day, the state STILL hasn’t paid.

This is their story.
